I have some sympathy for the original poster in this thread whose errors
seem  to me to be those of poor judgement rather than deliberate malice. My
comments were directed towards your original statement which was: (quote)" I
agree. Whether you are an intentional wrecker or not they have no legal
right to stop you using what you *paid* for."(end quote).  They *do* , in
fact, have a legal right to do so and it could be argued that they have a
m***obligation towards their other customers to do so as well.  It would
be a good idea to have a convenient method of appeal to Papyrus in the event
of misunderstandings or false accusations but that is a matter of customer
relations rather than legalities. It would certainly be up to the customer
to prove he was treated unfairly and that would be difficult unless he can
show evidence that others were treated differently for actions that were
substantially similar to his actions. He then would have to claim damages.
Even if a court would hear this case the damage award would be minuet since
he had received significant value already in the form of the offline portion
of the game. Call it $10.00.

The problem I have with that is you cannot ESC out, having to come to a

By the way... I DO have the replay if anyone wants to view it ... it's
2.6mb and it clearly shows me moving out of the way of everyone...
unfortunately me and another guy went the same direction to avoid one
another... BUT there was no wreck... and they classify me as a
wrecker.

Probably, but these sort of stories are good enough to put the fear of death
into me. One bad call proving enough for getting banned? -Jezus!!

Not that I would ever consider switching sides on the track with the leaders
barrelling down on me, but still.

Sounds silly, doesn't it? A 3-year veteran of GPL online races, scared to
run N4 online for fear of, as an unknown quantity, being mistaken for a
wrecker. True tho' ;-(

HIP HIP HOORAY!!

But: very sorry to hear the rest of your unfortunate story. I would
have thought the 'total ban' would be for people who are REALLY REALLY
REALLY obviously spoiling the fun, by ignoring every rule, driving the
wrong way, ramming one car after another.. and your story certainly
does not fall into that category :(

Pickup races with N4 are a nightmare, the main reason I put N4 on my
shelf and went back to GPL (ok, I also hate ovals :)
So while I applaud the efforts of Papy to keep online racing clean,
warnings should be given first in dubious cases are yours was,
certainly since you emailed them and explained them the situation.

Hope this situation gets resolved in a civilized manner for you..

Well, that's a completely different thing according to the original
person's account of events.  We're talking about someone who *claims* to
have a high LPI and ranking, who happened to have one bad race.  That's
not even close to the same thing you just described.

If he was banned from driving online (on WON), that's kinda over the
top, but if it's only Papy servers, well, that's their call, and I can't
argue with it at all.
