I watched the replay and I see no conclusive evidence of intent,
except to get out of the way.
And why wasn't the striking car holding his line, as the rules state?

Hardly, Papy could not prove it was Intentional.
They could say it looked intentional, but the court would know that
accidents happen.
There is no way that Papy could prove that he did it intentionally.

In the case of NASCAR4 I have successfully joined an online race without
going through sierra.com (ie direct connexion) that's as much as I'm
"entitled" to in terms of functionality offered on the box cover. the
sierra.com is an added bonus, except when everyone who makes a mistake is
permanently banned, and nobody can race there anymore, of course.

Of course, NASCAR4 is no longer available in any high street retailers in
the UK.
Not B.Hilton's problem probably, but a consideration for those of us racing
from the east side of the pond...
If it happened to me (and I mean being wrongfully banned if that is the
case) then I would boycott every papyrus product ever subsequently released.
Cutting of my nose to spite my face, maybe, but I wouldn't give any more of
my money to a company that did that to me.

Banning should only be used when it's totally obvious.
With totally obvious I mean a driver taking out every possible car,
driving the wrong way, waiting untill a car is behind him and ramming
him off the road.. we've all seen nutcases like these in N4 online.
Everyone can have a bad day, making a totally stupid mistake causing
an accident which looks intentional while watching the replay.
One can even get carried away during a race, getting frustrated and
taking out that frustration on someone else. This is only human, it
even happens to real life drivers, and one should not be banned for
this if it happens once.
Unless it happens more than once ofcourse..
A warning should be given first, with a clear explanation of why the
warning was given. The wrecker should have a fair chance to defend
himself. A second (or third) time a wrecker causes the same stupid
accident a ban would be justified.
