Ok, after playing around for a while I got my problems solved. Thought I
would share what I did in case anyone else was having similar problems.
My first problem was vsynch was enabled in d3d after applying the patch, and
could not get it disabled. I basically uninstalled and re-installed the
game, then uninstalled and reinstalled my video drivers, actually went ahead
and went up to the 28.32's. Using GeForce tweak utility I was able to
re-enable the vsynch function, and disable it in d3d. However, I do get
about 10 more fps in opengl, so I have switched now to running in it.

My second and biggest problem was the sound, whether 3d sound was on or off,
I was getting major static around other cars to the point the sound was
cutting out. Changing the buffer size did not help at all. For giggles, I
checked the output level under control panel for my Audigy gamer, and it was
at full. I reduced it a notch ( not hardware acceleration, but just the
sound output level), and then just used the volume control on my speakers to
crank it back up. Voila, the static is now gone and the sound is not cutting
out anymore. Interesting I didn't have this problem prior to the patch, but
this seems to have cured it.

Yea, never put your soundcard up to full volume. It just drives it into
clipping and causes distortion. Around 80% volume is usually good.
