person named Bow-Tie, who curiously enough has the EXACT same E-Mail address as
YOU 8-o !?! Weird Huh??? Might wanna see if your Mom has been secretly running
at Daytona on your computer after You're tucked in at night. Just a Thought.

It seems to me that if the "BETA TESTERS" have the track, the damage has
already been done..Could some annoymous beta tester step foreward and
release the stupid thing please?? Sega Smaaga..Or whoever is "warning"

I'd call a newspaper and see if I could make them look like fools for
trying to warn me about putting out some track I CUT & PASTED out of MY
game.. There is no data from Daytona International Speedway in the game so
how could someone STEAL something from them.. It sounds to me like they
are trying to claim something that isnt even theirs !!! What do you-all
think ?? I just cant see any seriousness in this.. How come nobody got
harassed for releasing the Brickyard ?? Now that sounds like something

I've seen all the pros and cons and to's' and fro's about this so-called
Daytona conversion, and I still can't understand how Daytona can sue if,
a) The track is renamed as something other than Daytona
b) The track doesn't even look like Daytona. After all it is based around
the Talledega track. How similar are these two tracks? I mean, if it was
released as Talledega II, where's the fuss. Daytona's owners wouldn't
have a look in.
Think about it. A conversion of the North Las Vegas track is freely
available. And the Las Vegas owners aren't making a fuss about that, even
though they gave nobody a permit to use their track name. And the
C***te track owners are not making a fuss, either. After all it's
their track, or at least, a licenced simulation of their track, that has
been stripped of some features and been renamed. Yet, no fuss from
C***te. Same with Bristol/Hutsville. No fuss.
I just can't see how Daytona have got a legal leg to stand on if the
Pit's conversion was released under a different name, with no reference
to the name Daytona.
I know it's true that I'm not the one who has to be afraid of litigation,
but surely there are some lawyers out there racing in the sim leagues who
can give an authoritative judgement on the chances of Daytona's success
in a court wrangle if their name was removed from the conversion
altogether. Of course, The Pits don't want anything to do with courts and
court cases, and I understand and sympathise with that completely. I
wouldn't either. But still, without the use of the Daytona name, I don't
see the problem.

For one, I'm tired of this whinning about Daytona. Look, The Pits hacked
out a Daytona. That's great. Daytona International Speedway heard about
this and asked them not to release it. Is that so bad? Yeah sure I know
your going to tell me that it doesn't include any data from Daytona, as
it's based on Talladega. Well guess what...International Speedway
Corporation (the group that owns and operates Datona) also owns
Talladega. It's only a step away from infringement...
Now before you'all throw flames down my throat just sit back for a minute
and reflect on what's happened in the past few weeks.
1) Papyrus has announced that they are working on NASCAR 2.
2) NASCAR has stepped in and gave Hawaii (soon to be called NRL)
legitimacy, by announcing that following the release of NASCAR 2, you
will be able to purchase the NRL software package enabling you to race
in NASCAR's official 12th (or was it 13th?) division.
3) There have been rumours that the Sega contract is up or is nearing
it's end concerning Daytona.
...c'mon guys...put 1, 2, and 3 together. What do you get? I really doubt
that NASCAR would jump in create an official (albeit virtual) division of
itself without the possibility of Daytona.
Why don't you just wait until Christmas and give the guys at The Pits a
break. Without their involvement much of what has happened since the
release of ICR2 would not be possible. If you must continue to pester
people about your lack of Daytona (and I just KNOW I'm going to get flack
for this...) why don't you annoy Papyrus about their unreleased version
of Daytona.
(...c'mon...do you think the makers of the game would do a little
"hacking" of their own...just my speculation of course :)

This is one of the major battles with Daytona is the fact that it is
based on Daytona and it use Tally's data.
Its O.K people in r.a.s saying 'Stuff them and release it' but there
not the ones who will have law suits against them and huge lawyers
bills.
The point is ISC is a BIG company, Sega is a big company and if they
wanted, they could both start on me.

year in the supreme court trying to fight some something that isn't
all that great anyway.

in some 'offical' form.
The dialogue I've had with Andrew Gurtis, head of licensing at DIS, is
very promising. Although he hasn't actually said as much, certain
things he has told me does give a strong indication that Daytona are
very aware of the situation with Papyrus and are trying to stay
bedfellows with Sega but still give Papyrus a go.
Please do! If your not asking me to write patches then its to update
the site. I have got a job and a social life too you know! ;-)

it!! The only thing the patch PATCHED was scenery, car speed by about
6mph, and that's about it. NOTHING ELSE CHANGED!! You guys seem to
think that the "patch"(tm) was actually going to look and drive like
the real Daytona. What would you think if I repackaged Bristol and
renamed it Seattle? Same difference.
