ICR 2 - Yellow flag bug?

I decided to add another dimension of "reality" to my game playing and
turned on yellow flags.  Now I am wondering if there is a yellow flag
bug.  While leading at Long Beach, Al Jr and I tried to pass a
backmarker (I was putting a lap on Al, a second on the other car).  The
other car was between us, it spassed, tapped me then hit Al.  I was able
to continue, Al did a bit later.  Yellow came out and the pass car
picked me up as leader.  A lap latter, here comes Jr. driving past me
and the pace car.  The others, suddenly I went from first to 8th!  What
gives?

  Well thats an easy one...Al is the former King of Long Beach and he
can damn well do whatever he pleases there.  
I guess I have to ask, do you have the patches for ICR2? or are you
running the already patched CART RAcing version?

I running whatever "updates" were loaded from the Sierra website when I
installed it.

It's a longstanding bug. There's no fix. I don't recall off-hand
whether any other tracks get affected besides The Beach.
