While I certainly wish we had Daytona available for N2, it is
International Speedway Corp.'s (owner of Daytona International
Speedway) decision to license it to whomever (including multiple
companies, or no companies) they like. They've chosen to license it to
Sega exclusively.
The mere fact that they made no money on it doesn't prevent Daytona
for suing for damages. If someone came and broke all the windows in my
house or keyed my cars, and I could identify who it was, I could sue
them for it, even though they didn't make any money on it. It's the
same basic principles of law, except the property we are dealing with
is intellectual property and not tangible, real or personal property.
It doesn't make it less valuable, just a little less obvious what the
"right" things are...
