Well, it appears there's a good chance it's not going to happen at all. The
Daytona page was allegedly taken off "The Pits" US web site after the
Daytona licensing manager called up Jan Kohl asking for an address to send
a "cease and desist" letter. They are apparently prepared to play legal
hard ball to prevent the "unauthorized use" of the Daytona name and/or
track likeness.
Now before you start flaming the Daytona folks, under the usual terms of a
licensing agreement, they have an obligation to defend the property (the
name and likeness of Daytona, in this case) against unauthorized use to
protect the value of the license to their licensee(s) (Sega, in this case).
So, whether this action was prompted by Sega, or they undertook it on their
own, it's likely something they had to do in order to uphold their end of
the agreement.
I seriously doubt that either Jed or Jan is in a position to put up a legal
fight and, as I mentioned in a previous rock, the penalties for
infringement can be quite severe and may even include a prison term.
This is something that the other people doing clone tracks might want to
take into consideration before distributing them on the net.
