I am not a lawyer (thank god), but:

If as they claim, they have given a company exclusive rights to make
car sims with the IRL name, another easily available sim with the same
name could be a breach of contract. Someone paid a lot of money to be
the only ones able to use the IRL name to sell more games. If they see
that anyone can get a free IRL game off the net, they will claim that
they may lose sales because of that. And that is what it all boils
down to, the almighty dollar.

Actually, the worse the game is, the more they need the license to sell
the games I think.

We're not free to do so, and we're continually violating somebody's
property. They either don't know about it or they don't mind. Why
should they? It may even build a fanbase so the license is more worth
the day a developer approches and wand to make a game. But if that
developer is paying another million to be the ONLY sim of that type,
they're going to send letter to Bodin.

Ubisoft was in the clear, the simmers were not.

     Again-where are all the golf course owners that (should, according
to the above precedent) complain when their courses are designed
via Jack Nicklaus Golf or LINKS and posted on the net?  Either
they, unlike racetrack owners, don't care (and see it as free publicity),
or there is some fundamental legalistic difference between racetrack
ownership and golf course ownership.  Perhaps that's it: golf courses
can be played by most anyone (public courses like Pebble Beach
being completely accessible if you have the $$$), but you can't
exactly drive up to Daytona, pay a fee to some guy in a toll booth,
and drive onto the track.  Publicity in the former, via simmed courses,
would then be seen as favorable (more greens fees), but in the latter
you can't drive it unless you are a certified professional.  >shrug<
    At any rate I guess we shouldn't hold our collective breath
waiting for a track design utility in any upcoming sim...  :-p

This is not a cool thing. The IRL has had few friends, and to pull this kind
of legal BS to one of the staunchest supporters of the IRL is just wrong.
All this will do is further anger people who are just looking for an axe to
grind with the IRL. It is very short sighted in my opinion.

I have a question.  If someone who had previously download the mod puts it up
for download, John can't be held responsible, right?  I mean, he has no control
over the actions of others...
Sounds like a loophole to me...
