Hi to all simracers,

As you probably know, a guy here is sending the Indianapolis Motor
Speedway track for icr2 to anybody that wants him.  I know him too well
and I just wanted to say something.  It's only for icr2.  So you cannot
have it for Nascar1.  But there's a "($/&?|! guy that is posting the
Indy track for Nascar1 on HIS WEB SITE !!!!.  Just to say that I
totally  not agree with this type of doing.  he's going into great
troubles. I never posted the track on a web site.  I never (except 1
time and I went in big trouble) sended the track on any knid of USENET,
Ftp site, Web, Gopher, etc.  I never said that I had the track, I just
tryed to make people read between the lines so they know that I send the
track free.  If everybody here put the Indianapolis track on their web
site we will never see good relationship between
Papyrus/Nascar/Cart/Irl.  I know that people here buyed the track.  But
others don't have this chance.  But it's not a reason to put the track
on a website.  'cause I know that if 1 person do it, everybody will
after.  And that's the problem.  We have to keep this "secret" inside
r.a.s.  We're a little communauty on the Net and sending the track into
Website is not a way of making people HAPPY!HAPPY!HAPPY!HAPPY!.  I
receive +/- 3 post each week that want to have the Indy track.  It's not
big.  But if EVERY web site in the Internet have it, we will all get
into trouble.  It's my opinion and I hope that you respect it.  Feel
free to flame me or to post other comments on this subject.  For the URL
of this web site I will write it here in r.a.s. if I see more than 10
person respond me.  And too bad for those little racers who want it.

I'm sorry, I just don't see the difference. They're both illegal
distribution of a copyrighted product. If you think you're any different
just because you e-mail the track instead of posting it, you're sorely
mistaken. And if you think your distribution is a 'secret' within RAS,
you're also naive and stupid, especially with the presence Papyrus
maintains here.

And then what about all those Web sites that have modified tracks..?
If you say that modified tracks aren't copyrighted the even Indy for
Nascar or Indycar isn't copyrighted because it's modified from Indycar1
And it's not modified with a Papyrus utility .

They are probably infringing. (my opinion only, IANAL.)

The original files are copyrighted by Papyrus. The modifications to
those files can be copyrighted by whoever did the intellectual work to
create the modifications. *However*, the original files remain subject
to the Papyrus copyright, and therefore the modified files are a
derivative work, and subject to the Papyrus copyright.

For a simple example:
Original sentence: (copyright entity A)
The brown fox jumps over the lazy dog.
Modified sentence: (based on the above sentence, modified by entity B)
The quick brown fox jumps over the lazy dog.

entity A holds the copyright on the first sentence.
entity B holds the copyright *only* on the changes to the sentence
The second sentence is a derivative work, and is subject to entity A's
copyright.

The internal files are copyright Papyrus, while the actual names of
tracks are copyright of the track owners...Basically, all is bound by
copyright.

So, AFAIK, if you made (per exemple), A Daytona track for Nascar2 with
Tally as a base.  Tally will be a Papyrus/Sierra/NASCAR copyright while
the Datona part will be Mister X copyright.  Or will it be Tally=
Papyrus/Sierra/NASCAR copyright and Daytona=NASCAR copyright??  There's
a big difference between the two of them.  BTW, I'm proud that a
INTELLIGENT thread is going on here on r.a.s.  It's been a while since
this.  The HUGGINS mistery was not very mature at a time, and compared
to other newsgroups like rec.arts.sf.starwars.misc, we don't have many
serious discussion.  It's always "I have a question please answer me"
and two person respond to him. Finito.  Nothing else.  Also, some humor
could be O.K. here sometimes.  Like "Your an Racing simulation ***
when..." or "Your a r.a.s. cool guy when...".  It makes the newsgroup
more fun and more intimate.  More like a family, or a communauty.  So
now, who's ready to those two questions above?? :)
