So now that NASCAR 2 is out and Daytona was NOT included how about some of you
hacking wizards producing a DAYTONA Patch.
I remember this topic was considered off limits and Daytona threatened everybody
who was attempting to release the patch a few months ago but now that we once
again do not get to race Daytona lets stick it to em and get our OWN TRACK out
there.
With the recent release of DAYTONA USA (which sucks by the way) there should be
plenty of graphics and artwork to use as source material for a NASCAR 2
compatible version of this track.
HOW ABOUT IT???
Notable threadCalls for a hacked Daytona track for NASCAR Racing 2
After Daytona was left out of NASCAR Racing 2, some urged hackers to make the track. Others explained that Sega held the exclusive licence and that earlier hacks had been stopped with cease-and-desist letters. Papyrus's Jim Sokoloff said that if Papyrus had the rights, the track would be on the CD, explained the Daytona USA billboard and theme-park time trial exhibit, and noted that Sega had paid millions for the name.

Well that's in the corporate's right to defend the exclusive deal with
Daytona. It is copyright infringement. As stated numerous time here that
Sega looses its rights in April and hopefully Sierra/Papyrus is
negotiating a deal to bring Daytona to Nascar 2 and NRL.

I'm sure when Gerhard (sp) gets his copy of N2, that he'll be hard at work
to try convert Indy. As for Sega, well most of us here know what quality
game Daytona USA is or isn't and should stick to console games.
EH
Of course there is no official Daytona yet. There legally can't be
one, as Sega still has the exclusive license for the track. Only after
it expires can one be made, and with Nascar behind it I fully expect it
to happen.

I hope they include the new tracks as they come to Nascar, such as
California and Texas...
Personally, the cynic in me is just waiting for a the proverbial other
shoe to drop--if an official Daytona track gets released.
Imagine this: the Daytona track would ONLY be distributed if you are a
paying member of the NRO!
Sure, all it would take is for one guy to post it on his web site, but
hey... the more I hear about it, the less I feel inclined to get on TEN.
Of course, I don't have WIN95 or a 28.8 (or faster) modem, or even a
Pentium for that matter!
Aside from all that cynicism, I sure would like to see a track pack that
features Daytona, Indy, N. Las Vegas, Texas, and California. In my
dreams, of course. And when pigs fly. And when Lucifer starts buying
parkas wholesale.

That's a gross misrepresentation. Daytona has an obligation to defend their
property (the name and likeness of the track) or lose it. They licensed
that property to Sega, which means that they had an obligation to Sega to
defend Sega's licensed interest in that property. Now along comes someone,
innocent or not, who is infringing on those property rights. Daytona has no
choice but to ask them to stop, that's just the way property laws work.
Not once, did I ever hear any "corporate big-wigs" promise to put Daytona
in N2. What was actually said, by either Ed or Adam, was that continued
efforts to make an infringing version of Daytona would likely sabotage
Papyrus' efforts to secure the rights to it.
I heard Marc Nelson (SRN) say recently that Sega had managed to secure
exclusive rights to Daytona for another 3 years. If so, that means no
Daytona for N2, and perhaps no Daytona for N3. But before you start
lambasting Papyrus for it, get the facts straight: It was never in their
hands to decide this. As I understand it, Sega's agreement with ISC gave
them an option to renew their exclusive rights, and it appears that they
exercised that option. Se Fine.

The corporate big-wigs stepped in and said NO NO NO because Daytona was

and wwe could have ruined ANY CHANCE at getting the license from them.
Nobody at Papy or Sierra
ever said it would be included in the initial release of Nascar 2. In
fact Adam had said
numerous times that the the license with SEGA does not expire until April.

Your understanding is mostly correct -- Papyrus first needs to secure
a license (doesn't have to be exclusive) to use the track and its
likenesses. ISC are more apt to give such a license if there aren't
some slap-happy pirateers on the Internet flaunting a hacked Daytona
in their faces.
However, it's not gonna happen any time soon. If you've noticed,
Daytona USA is now out for PC, which leads me to believe that Sega
exercised their right to renew the exclusive license for another three
years.
FWIW, Papyrus wants to do Daytona and Indianapolis DESPERATELY, but
the licensing issue is preventing it. Those on r.a.s. that are
condemning the Watertown gang for the problem are shooting blanks at
the wrong target.

Perhaps you missed some key Daytona-related posts a while back, but
Papyrus cannot provide the track with NASCAR 2 strictly because of
licensing reasons. Sega has the exclusive rights to use the track in
their software and cartridge games, from what I understand. It is not
a conscious decision by Papyrus and/or Sierra to disappoint the NASCAR
faithful by not including a track with the Daytona likeness, it is
purely a legal issue. So anyone that attempts to provide such a track
without permission is not "sticking it" to Papyrus, they're
challenging the law and risking the possibility of severe fines and or
jail time.
If this is true, then why in the credits for Nascar 2 when you're exiting
the game does it list Daytona USA, used by permission of
etc....etc...etc....???

From what I've heard there is a billboard in the game somewhere that says
Daytona USA. I guess they have to liscense that also.

Actually, they can probably work on it now. They just can't release it

I don't know if it will help, but if this DAYTONA/SEGA arrangement
bothers anyone, try the discussion section of http://www.daytonausa.com/
This is the web site for International Speedway Corporation, the parent
company of Daytona, Talladega, etc. Maybe ISC would be impressed by a
lot of postings from NASCAR sim fans. After all, from their
perspective, this is ultimately about furthering the fan interest in the
real sport, isn't it? NASCAR Racing has to be better at that than a
SEGA game. Maybe one of their bean-counters is a sim fan!
This is UNOFFICIAL. (IANAL, I'm just an engineer.) This is my take on
things:
Sega has exclusive license for home and arcade versions of "Daytona."
Daytona USA licensed from ISC the rights to use the track and
contracted with Papyrus to develop the Daytona Time Trials stations
you mention.
I (personally) want to include Daytona with our products. Sega's
license (from ISC) prevents us from doing that, as our product is for
home entertainment on computers.
IMO, Sierra/Papyrus are not the bad guys here, capriciously
withholding Daytona from you. (What would we possibly have to gain by
doing that?)

Jim, I am not sure that I call what I do with NASCAR2 "home
entertainment". I am not sure what I call it, but it is something else,
I certainly put a heck of alot of effort into it. What if the majority
of us all agree that it is something other than "entertainment", could
we be able to get your corp. lawyers to find a loop-hole for us? <G>

Hmmmm, that was the situation several months ago, but now the license
has gone bye-bye for another number of years. Track editors may now be
dusting off their tools....
I'm not so sure, but admire your confidence.
Cheers!

like your idea... Call it anything they like...

I fail to understand the logic of how what some hacker does will affect
the decisions of the corporate world where only money and influence
counts.
