Well, I have been able to discover "what" caused the problem with the "post"
showing it as a binary, or with a binary attachment....when it was an "all
text" (in HTML format though) post.
Here's what happened: When I requested a "digital" copy of Steve Pages
letter (I had a hard copy mailed to me as did everyone else on the cc list),
they didn't go to the MS Word document to send me a copy. What they did was
to scan the hardcopy, pasted it into a MS Word document (as a
bitmap)....added no other text to that new document, named it the same as
their original MS Word document and sent it to me as an attachment to
"request digital copy" email as a "reply" document. This makes their
attachment have a ".doc" file extension, which is what it would be if it was
a MS Word text file.
I guess Mr. Murphy was working over time yesterday. It figures this kind of
thing would happen to a "controversial" post....... I still have to take
responsibility for not picking up on the fact at some point...the huge file
size of my "post." But, one complaint of "Outlook" .....is it doesn't
display the "size" of the document you are creating until you send it (it
shows up on the "Sent" list with a file size). I just didn't pay attention
even then, although I don't think there's anything I could have done to
correct this after it was sent.
So, now I'm in a quandary as to what to do about this. I can not download
that post. Obviously, I know it's content....but this also means I can't
read any messages in the "string"....so I can't reply to the ones that may
need/require it. If I "repost" the original message....it is still going to
have a "binary" attached to it because even though I can reduce the file
size of the "graphic" of Steve Page's letter (converting it from .bmp to a
.gif or ?).....it's still a graphic file. I don't want to make matters
worse by doing this. And, Steve Page's letter is important....since Tim has
told our attorney this morning by telephone that he does not believe Steve's
letter is authentic (when asked if he then thought it was a forgery....Tim
would not respond).
I guess then I will defer to the advice of the "newsgroup gurus" here....and
do what you collectively suggest as best.....at this point.
Regards,
Tom Pabst
PS: There is a "string" under a post of the same topic by "ymenard"
below....I'll go see if any of those need a reply. Also, I will use in the
"Subject" line the following (for any post I make on this topic from now on)
"SearsGroup:" Those of you who don't want to be bothered with this mess can
use "SearsGroup" to filter all these posts out. I'd like to do the
same....but I can't....of course.
SearsGroup dispute over the Sears99 track
Tom Pabst of SearsGroup explained a posting glitch and continued a public dispute with former collaborator Tim McArthur over the Sears99 add-on track for NASCAR Racing 3 and a Sears Point Raceway letter about use of its images. McArthur said SearsGroup owned no rights to the track's files and accused Pabst of threatening sites hosting it. Readers were split between finding it interesting and wanting it taken elsewhere.
Automated summary.
Tom,
Well I do not know you at all, but I would recommend not airing your dirty
laundry infront of the world. In the past I have discovered guys who do
this basically have nothing to base anything on a court of law.
If I am right Tim was wrangled into this whole deal by your post, if I am
incorrect then I am sorry, but I think you need to take it to court if you
have a case and well if not then I guess keep trying to win the war or RAS
opinion.

Take it somewhere else will you, you are becoming very annoying!!

I called his office and asked Bonnie (his sec) to send me a "digital"
copy.....I already was cc'd a hard copy at the time the letter was sent to
Tim. My scanner was not working....so I asked her to send me one in email.
I think this is what you are asking? Correct?

I disagree -- this is a pretty interesting thread which directly affects
sim racing. I'd certainly like to hear both sides of the story. It's a
helluva lot more intersting than people talking about me, and a
googleplex more interesting than me talking about the law... n'est c pas?

Indeed! But it is also interesting from the standpoint of copyright law
-- kiddies: instead of conjecturing about how many Warez fit on the head

application and implications of US copyright law. An ounce of fact is
worth more than all the fiction in the world.

This IS "Peoples Court" and you guys are "Judge Judy"...... I stated that
very clearly in the first post about all this.
The "copyright" matter however, is not between Tim and SearsGroup. I don't
know how to make it much clearer than I've already done...yet people still
make posts about "SearsGroup wanting to own the track....and Tim wanting to
give it away!" Geeesh...can some of you not read English?
One last "simple" try: Sears Point Raceway and their parent company
Speedway Motorsports, Inc. own the track and it's "likeness and
logo"........that means anything that represents Sears Point...the race
track! SearsGroup did...and "is" doing work for Sears Point Raceway as a
consultant....not as an employee, not as an "owner" but as an outside,
independent contractor. Part of that work...involved the production of a
simulated track representing Sears Point Raceway. SearsGroup, by agreement
with Sears Point.....gives up all creative rights to this track to the
track's owners (which is Sears Point Raceway). Tim, working with SearsGroup
during part of this process, came into possession of certain files and
data....because he was working on the same project for SearsGroup. He does
not have the right to distribute that data in any form....let alone as a
complete simulation of the track....without Sears Point Raceway (the owners)
permission to do so! Which, they have not given Tim....which they have
specifically denied him via Steve Page's letter to him (copies of which have
been posted on this newsgroup several times).
You guys don't even need to comment on this issue between Tim and Sears
Point Raceway. This is not in dispute....it's a "black and white, case
closed" legal issue. You only need to know about it because it is germane
to the issues between Tim and SearsGroup. Those "issues" are not black and
white......those issues are varied, complicated and in some ways, go
directly to the heart of the future of sim racing...and this communities'
existence a few years from now!
That is where this discussion....this dialogue is interesting to me....and
to many others. I have gotten ten times more email about this than the
"posts" displayed here. Those of you that are not interested...or have
nothing to add to the discussion can simply "filter" the topic by subject
matter. I made this easy.......by putting the format of the subject always
starting with "SearsGroup:" Just use the word "SearsGroup" in your filter
and none of this will be displayed.
What else am I supposed to do?
This is not a personal campaign of mine to attack Tim McArthur. He isn't
even a "factor" in anything we are doing currently at SearsGroup....and he
hasn't been for five or six months! We don't even use the "tools" he used
to build the Sears99 track anymore! Am I interested in "why" he is doing
what he's doing? Of course, I have asked him this about a dozen times and
always get some runaround answer like he gave on the telephone number for
the Sears Point track. So, I assume he is not going to give me an answer
and I've stopped asking him. I now assume he didn't think what we were
doing had any merit. I assume his decision was "an informed one" since he
was working intimately in the process......that's his right to
make......whether I agree with it or not....is not part of the equation.
I'm trying to lay all this stuff out on the table so two things can happen:
1) I can figure out how we (SearsGroup) can be a part of this sim racing
community....which we need to be....and not be ducking arrows and bullets
from Tim all the time. So....my goal is to "air this crap" between us and
get it over with.
2) The whole future of the sim community is based on what we've taken for
granted for 5 years.....that some "game developer" will produce a "game"
...that we can use as a "full simulation"......and that is a huge "question
mark" at this time. It never has been in the previous 5 years! So....this
topic gets you guys thinking....postulating, yelling at each other (and
me...sometimes)...but it is productive in that it forces us to look at this
situation from varied perspectives. I thought it would take a day or two to
get past all this "name calling" and crap....then we'd get to hear from the
smart guys in this community who I am dying to hear from! I want to hear
from the guys who are still here that were running Hawaii 4-5 years ago.
Where are you? Where's Ken Hower? Where's Pekka? Are they relegated to
Jacob's news server with "handcuffs" or something (by the way...I think
Jacob's news server is one of the best things that has ever happened in this
community....nice job Jacob...and thanks for the continued expense and
effort you make to provide it).
So...lets get to the good stuff? Can we?

How important do you
think your little "project" is? The only person ruining the future
of "simulated racing" is you, by stirring this pot and not shutting
your mouth. YOU are the "person" bringing unnecessary attention to the
Sears99 release. We can only blame you and whoever may still be
associating with you for the legal mess SearsGroup is trying to
create. Why anyone would want to participate in such a program with
someone with an ego like yours is beyond me.
You do realize you're alienating your potential customer base, don't

>make posts about "SearsGroup wanting to own the track....and Tim wanting to
>give it away!" Geeesh...can some of you not read English?Corect, SG and myself have no copyright issues. They (SG) do NOT own
or have a copyright to any of the files located within Sears99.
Here is where our disagreement begins.. Yes SPR owns the copyright and
likeness of the track. Tom, made an agreement with SPR about a track
that was not built by him or his company. Tom or SG can not sign away
files and/or property not owned by them to begin with. I have yet to
recieve any request to remove Sears99 from the web even though I have
requested in numerous times.
Again, I have never worked for any company or been a part of
Searsgroup in a business venture. Tom and I got together to build
Sears99 as a hobby project that was to be released at the time of
completion. We parted before it's completion so I finished it myself
and released it. At some point Tom decided to form a company off my
work, promise my work to SPR, and market it to other tracks, all
without my approval or signature. I have never signed any document
stating that the work or files I did in Sears99 was to be owned by any
other person or comapny. I surely do not remember ever getting a
paycheck from SearsGroup or from SPR as a consultant.
Well we agree in this area as well. The issue is very black and white.
Tom has nothing to validate that I ever worked for SG or ever sold or
gave away the work I did in our hobby project. If Tom signed off the
Sears99 track to SPR, then that is called the theft of my intelectual
property (something that is being legally pursued at this time)
I am up for discussion about the matter and always have been. I have
tried numerous attmpts to email you (ignored) and have even tried
calling (also ignored). Your lawyer keeps telling me he will get back
to me on some suggestions that I have offered in the past weeks yet I
have never recieved a call from him.. ever. I have been the person
calling your lawyer Tom... constantly in fact. He sounds very iritated
that I keep calling him... I kinda like that.
Sorry Tom (and anyone else) that may think Im throwing arrows at
SearsGroup. I merely was trying to correct the false statement stating
that I worked for SG.
missed a spot on your nose Tom.. yea that little brown spot there...

Don't take this as an attack on you Tim, I've only known you for a very
short time but I've already come to like you a lot and appreciate you as
part of "The Pits" and I think you know where I stand in all this :-),
but if nothing else, I think these threads with you and Tom going at it
clearly demonstrates to the rest of the group why guys like David Noonan
don't post here often
You are spending time here battling it out over something that is given
away for free when you could have spent it creating more excellent
tracks for all of us to enjoy, hope you guys get it sorted out soon, I
want more tracks :-)
Beers and cheers

Is there a chance that you might be able to create Spa, Silverstone, or
Rouen for us fender bangers?
Those would be way-cool tracks for NASCAR.

entertainment I get from our thread. More tracks? already in the works

Yep Tom, I read it all, I'm sorry if I'm just not smart enough!
Good luck with SG. Go and survey as many track as you can, and then make
the data base freely available to anyone who wants to make a track.
that's if the track owners will allow it. But hey, if they won't allow
it, then don't work for them. Let them move mud in reality, at huge cost
if they get it wrong.
I think your biggest worry must be a rival company starting up, guess
what...someone is doing just that.
