Were those incidents the ones he describes or different ones? -Were you the
one to protest his driving?

Flame warAlleged victim confronts banned NASCAR Racing 4 driver
A poster named Justin, who said he was the driver hit in the incident, claimed the banned B. Hilton had tried to wreck him several times and deserved the ban. Hilton denied it, questioned whether Justin was real, and claimed Papyrus had been reported to the Better Business Bureau, while regulars mocked him. Side discussions covered whether the NR4 EULA and WON access were part of the purchase, and scheduling of a GPL league race.
Automated summary.
Maybe now things might become much clearer with both
sides available now? or maybe not? only time will tell..eh?

I think everyone should read this carefully before making anymore
judgements in either direction. This is the person hit by Dodgefan.

I've read it, doesn't really show me the other side of the story. Pretty
obvious the other party thought it was wrecking, the man got banned!!
I'd like to see some motivation, plus the victim's thoughts as to why BH was
out to get him.
Also we still don't know whether it was Justin who made the complaint or
someone else in the race.
Jan./can't stand the suspence!! -I'm way too curious.

I NEVER WRECKED YOU IN THAT RACE MAN!!!! I'm sorry for what
happened... but you must be talking about someone else? If I was
going after you I would have parked and waited on you? Besides, what
would have made me single you out anyways? Yes, I'd love to see the
replay of the WHOLE race if you have it might be quite interesting
indeed

The replay posted
doesn't show me racing and letting other cars pass... if I was a
wrecker I would have parked in the middle of the track... or waiting
on him to come back around..... also, why would I have singled him
out??? NO REASON!!!
Yes, the incident was my fault... what did it cost... NOTHING... I"M
THE ONE WHO WRECKED... HE DID NOT!!! not even damage for him...
and I can assure you it was in no way intentional... i don't waste my
time online wrecking people on purpose... there are other games for
that if I felt the need.

You know, you keep saying that. I have to ask - how much experience do you
have with intentional wreckers? You seem to know a lot about them... The ones
I've seen don't always to that. There are some who will run with you, but just
run you over as they try to pass.

Anyhow, I can sort of go along with the Spa sentiment. If one gets unstuck
there, one probably will have a fairly big and terminal off. Monaco has a
six major danger spots, but actually could work quite well if we get some
level headed people to drive it. Rouen is a great track, IMO, but does have
some accident hotspots as well.
Gotta face it, Historic GP racing is dangerous.<g>

I am sure they are, but I am also confident that the huge EULA that is
inlcuded with the purchase of every copy of N4 will cover their butts. The
moment you open the box and Install the product, you are agreeing to abide
by the EULA. I wouldn't be suprised that buried somewhere inside the EULA
is a phrase that refers to something like the following. "we reserve the
right to make changes or ammendments to this agreement at anytime." It is a
powerful sentence and basically frees them to make as many changes or
alterations to the original agreement as they like. That can have nasty
effects on some users, but other than hard feelings, leaves little room for
legal recourse.
As far as the Sierra forums, they provide the space, the upkeep and the
connection costs, they can pretty much ban whomever they choose for whatever
reason.

Yes, Monaco is dangerous is a different way than Spa. At Spa slowing
down at the dangerous places removes most of the danger, so you can
run at a safe but slow speed which is the way I try to do full GP
races. Monaco is dangerous at any speed. Rouen is somewhere inbetween
because of the hairpin and the kink in front of it..

what's usually being overlooked is the fact that IMHO legally, the right to
race on WON isn't part of N4. It doesn't say on the N4 box that racing on
WON is a feature of N4. I.e., the ability to race on WON isn't part of the
non-verbal purchase contract you agree to by buying N4.
Hence, the EULA doesn't affect this banning issue, as the conditions you
agreed to when buying N4 didn't contain WON. Therefor, there's no way of
making legal claims if anyone gets banned from WON.
Apart from that, if Papy doesn't ban you for one strange incident, but
creates a track record of suspected wreckers, I'm fairly sure that if a
wrecker would sue them he'd have no chance. Even if WON were something he's
entitled to, all the guys he wrecked are entitled to the same, and he's
greatly impeded their use of the product.
By wrecking them, he's also violated the terms of use of WON (at least very
much so since the terms of use of WON - Message of the day - contains a
clear statement that wrecking isn't allowed), and all Papy did was making
sure the other buyers can use the product as intended.
Maybe one could even sue wreckers, on the premises of harassing others, of
causing mental stress, or even physical damage. What if someone got
momentary heart probs out of anger because he got wrecked? :-)
