Greetings,

I've been following your posts on the General Discussion forum
regarding a release of NASCAR Racing 2004 Season. We here at Papyrus
would like nothing more than to continue making NASCAR games.
Originally we had planned to do so, but unfortunately our parent
company, Sierra, no longer has the licensing rights that would allow
us to do so. We had many new graphic and physics features planned and
finished that would have made it into the release, such as fully
viewable opponent pit crews, brake wear, tire blowouts, a nighttime
rendering engine, and seamless multiplayer integration of 3rd party
mods as was viewable in the NASCAR Racing 3 series.

While we share your eagerness for a further continuation of our
flagship product, practical realities dictate that this scenario will
not come to fruition. The immediate future has us locked out of
obtaining the NASCAR license as we would like, but who knows, a NASCAR
Racing 2010 release could always be on the way. Or maybe even sooner,
if circumstances change regarding the status of the current NASCAR
licensing.

In the meantime, we appreciate your interest and purchase of our game.
Without your patronage, we would have never made it this far.

They have a License for NR2003, right ?

So, what prevents them from coming out with NR2003 V2.0 ?

I can't help but think there is more to this than License, though I have NO
doubt that Sierra is our true obstacle.

That's actually a good idea.  I wonder how that would work, in terms
of releasing a patch that practically turned it into a new game.  I
suspect whoever owns the franchise now must have that as part of the
contract, that Papy couldn't release a patch that would be the
equivalent of a new game.  But an interesting idea though.  I suspect
just about everyone who owns N2003 would certainly be willing to pay
for a patch with the feature set described in the parent post.

EA's license covers NASCAR.  Period.  Any PC Games bearing the NASCAR
name (and official drivers, tracks. etc.) will ONLY be made by EA from
now on.  Good idea, though.  ;)

Fine, call it something else. We all paint our own skins anyway. I can
remember the days of, was it N4, we couldn't have Daytona since someone else
had *that* license. We got it anyway IIRC, and called it Volusia County
Speedway.

Hmmm.  What license agreement does CASCAR have?  ASA?  USAC?

My favorite part about the Papy response.
"Yes we have NR2k4 almost done, it includes everything you have ever
wanted, in extreme detail..and through the magic of our Elven
programmers will run with full options on a P90.....but we can't let you
have it."

If that wasn't a comment from one of the developers, I would say his
comments are exactly the kind of thing that could start a nice Internet
Myth.

THEY have the game man, but THEY don't want us to have it....

Let's hope NASCAR wakes up at some point.

Yes, but it's not a new name.  It's just an update.  As far as I know, they
can't take away their right to "Nascar Racing 2003 Season" or how they
patch/change it.

I'm sure the lawyers would have fun with this :)

But, I doubt Sierra has much interest in us so it's probably a moot point.
I'm sure the actual Papy guys would love to do something like this.

I'm pretty sure no one but EA is allowed to release anything NASCAR
related from 1/1/04 to 12/31/09.  I'd assume that includes expansion
packs and probably even patches.  While I'm sure Papy could try to
find a way around it, I'm not sure it would be worth the legal hassle.

A patch could easily be done.  You can call it N2003, and it could be
an enitirely new game, but persoanlly I doubt all those bells and
whistles exist, becuase it could have beeen already made avaialble.

model of a downforce version of GPL for years now(think to yourself, GPL '72 or
GPL '76)have we seen that?
   Sometimes they can sneak a patch out, like the GPL d3d patch which
was done by one guy in his off time.   But unless Sierra allows Papyrus to
work on something, by that I mean release funds to pay for said work, we will
never see the finished product.
   Remember too that EA could look at a 'patch' with the features described in
this and other threads and complain that it really is a complete new sim, not a
patch.  When companies complain, lawyers usually get involved.  Even if a suit
is groundless, it could cost far more to Sierra than any profit a patch might produce
for a deadend pc game.
