I have a question

With all this flap over tracks, is it legal or not, I have a question.
The sponsors of the cars have licensing deals too. I understand that
Racing Champions can't put certain logos on the collector cars they sell
because they don't have the license to do so. Papy didn't put some cars
in N1 because of that. Or they modified the sponsors. What about all
those cars and car sets using unlicensed logos? Are they breaking the
copyright laws too?

Just curious to see if I broke the law at all...

This is sort of the grey area in the simracing community.  It probably is
infringing on copyrights when we paint a car that someone in real life
drives, but distributing the car is basically just publicity for the
sponsor, rather than an infringement.  Havoline or any other company could
threaten to sue the person who drew the car in question, but it's really
not worth the time or the money.

I don't know about you or any of the other people providing cars, but
Richard's and mine are purely "art".  What others deem to do with them we
have no control over.  Since they are purely "artistic" expressions of
"real" things, I highly suspect we are not in violation of
copyright/licensing agreements.  Otherwise how could one ever hope to
publish a picture of a real car with all of the details in a magazine?

Alot of the reasons behind Papyrus not being able to include
"unlicensed" cars in their product has to do with the facts that Papy
made a concerted effort to license their products and also that any
appearance in their sim would imply an agreement with said companies and
logos.  Also, they do not wish to foul their deals with the companies
they do have licenses and permission with by including those where they
were unable to obtain such.  They are also making $money$ off of their
products, must of us starving artists aren't!

"art for art's sake
money, for God's sake"
