A while back, I unknowingly sold my Indy trackpack for
Indycar, so could someone give me some pointers as to how I can get
the Indianapolis Speedway for Indycar2? I've looked for that track
pack in stores, to no avail. Any ideas? Please e-mail if it's no
trouble....thanks!!

IndyCar Indianapolis track pack goes out of stock
Players looking for the Indianapolis track pack, which could be converted for IndyCar Racing II, found that Papyrus had sold its remaining stock and was no longer selling it. Some suggested that copying it was now acceptable. Rick Genter replied that copyright still applies to out-of-print works and that Papyrus's licence with the speedway probably did not allow the track to be given away. One poster found copies for sale at the Indianapolis Motor Speedway gift shop.

I will confirm. I just called the papy phone number and they told me
that they no longer carry it. Too bad. Just in time to hurt those of
us that want to learn about the Brickyard 400.

I think you would find that the pirate thing applies only to a product
that the company is still selling. If they would offer it for sale I
would buy it if not I'll get is some other way.. jep
See I told you.. Now if we can get some one to upload this some where
we would be in great shape.

Not true. Just because a book is out of print doesn't mean that its
copyright no longer applies.

Copyright law doesn't work that way. The copyright is valid regardless of
whether the product is for sale or not. You have to remember that copyright
law didn't start with software, it started with books, music, art, etc. If
I write a song, that gives me the right to determine who performs it and
what, if anything, they pay me in return for it. The same basic principle
applies to software. Last I checked, copyright infringement was punishable
by up to a $10,000 fine and 6 months in jail for EACH infringment, ie. each
copy you make.
When you buy software, you're not really buying the copyrighted work,
you're buying a license which allows you to "perform" the work on your
computer. If you want a legitimate copy of software that's out of print,
you have to get someone else to give up the right to use their copy,
assuming that the license allows that kind of transfer.
Disclaimer: I am not an attorney, but I do run an R&D company that licenses

contact either the BSA or SPA via their 800 numbers and get the straight
scoop.

If this is the case couldn't we ask Papy for permission to upload it
somewhere or ask them to. It would only increase the value of their currently
existing games. They won't be losing any thing because they can no longer sell
it. I know that if there was some way to race in the Indy 500 for Indycar 2
then I would buy it, but since I can't then why get it. I'm sure that others
feel the same way, and that Indycar2 and Nascar sales will most likely go up
if we were allowed to download the Indy track.

I didn't say it expired. I said that I don't believe that it gives us
permission to give away the track.

okay, then I am confused on this issue. Is it still possible to phone the 1-800
number and order the IMS addon program? I would be interested in
ordering this addon as well as any and all other addons for nascar
and indy car (I own indycar II and nascar incase you wanted to know).

I don't know. My understanding from reading r.a.s is that it can no longer
be ordered. No one has told me anything, and I'm not even sure who to ask
at this point...

I too spoke to Papy this morning. What they *were* offering was extra
stock they had left over from their last run of the product. It hasn't
actually been manufactured for some time now and they are definitely out
of stock.
I asked them about their position regarding copying of the program now
that they no longer offer it for sale (BTW they *still* hold the license
for it - see an earlier message in this thread saying they had lost their
license). Papy said this was illegal even though they are not selling it.
The provisions of the original copyright still apply. However, it has not
been discussed by the management group at Papy. I am guessing that
prosecuting someone for copying the program may not be high on their
priority list.
There was one other interesting comment. Papy said that using the
conversion utility to run IMS with Indycar II *is* a copyright violation.
This is interesting in light of all those lucky owners of IMS that are
saying no to sharing the proggy with the rest of us due to copyright.
They will happily violate copyright by converting the track but shy away
from sharing it with others to avoid copyright violation. Strange indeed...
BTW, I am one of the unfortunates looking for a copy of IMS. I will
gladly pay for it if someone wants to sell it or if they want to make a
copy of it... :-)

I too am looking for a copy of Indy (not necessarily a illegal copy just a
copy.) If I can't buy it then I need help getting it some other way. E-mail
Thanx,
SLURF
Copyright violation? No way. Once you buy software you can do whatever you want
with it as long as you don't give or sell copies of it to anyone else, or
include it in your own programs. You can reverse engineer it, modify it, use it
however you want. I think the conversion falls under the same category as
program 'cracks'; it doesn't distribute any of the original program's code, it
modifies what you already bought. Nothing illegal about that.
as recovered through Deja-News. Guess they had a change of attitude ?

Actually, this isn't true. Many software licensing agreements explicitly
forbid reverse engineering, modification, etc. Be sure to read the
agreements in the future.

I don't think so. I think modifications to software are allowed for
personal use, but distribution of modified commercial software is
illegal in most cases.

Probably the same deal as You can't reverse-engineer the program...
THIS is what's sad. People are willing to BUY instead of copying it, and they
CAN'T :(
