He has claimed that I (or SearsGroup) have claimed ownership of Sears99 for the advancement of personal interests. That has never been the case....nor could I enforce such a claim even if I wanted to. I did write email to several websites that were initially "posting" copies of the Sears99 track, when we first learned what Tim was doing. I informed them that this (Sears99) was the property of SPR and SMI, and that Tim was not authorized to distribute the track file publicly Pathetic. You remember guys a thread I made on r.a.s. about third-party groups creating tracks without the approval of the track owners? Here is what happens when stupid track owners and lawyers piss off on people like Tim who just want to have society appreciate the work of some people. Oh well... Weird thing about it, I have YET to recieve anything from sears point or SMI requesting me to stop posting Sears99. Though I have recieved a 3 page letter from Tom Pabst's lawyer requesting it. Hmm, Tom? You ever going to answer any of my emails? On Fri, 08 Sep 2000 02:35:25 GMT, "ymenard" <[email hidden]> wrote:

Although I have my own opinions on this matter, I think its best I don't share them in public. I will say I have known Tim and communicated with him on and off for the past year or two in various capacities and I don't question Tim's "integrity" in the least. I only say this as Tom has placed his integrity up against Tim's. However, I do have a question or two. Tom says "Tim was an active participant (as an equity partner) in SearsGroup activities from approximately October of 1999, to approximately April of 2000. Yet... the letter from Theodore W. Phillips says: "These claims are totally unfounded since you were a NON-EQUITY partner of the partnership and were entitled to reimbursement of certain expenses and compensation only when certain financial conditions are met." Hmmm... sounds like somebody needs to get the story straight. Also, as I haven't read anywhere how SearsGroup, which consults and from my understanding modified N3 files, obtained permission from Papyrus for these commercial activities ? Lastly, I don't think anyone needs to worry about the communication between Tim and Mr. Noonan or whether or not Mr. Noonan will continue his fantastic efforts for the sim racing community. After having read the nice rhetoric by both parties (for which I think Tim did most of the writing himself and Tom had some help from his lawyer), I just have one question: why do you either of you think it's important to gain the sympathy of this newsgroup? If either of you really had such a strong case against the other, you could just have it over and done with... Cheers, Herko
Exactly, Tim just wants to be left alone, with what he helped create. Tom wants it all; Glory, Respect and MONEY MONEY MONEY! Tom, et al are the ones hounding Tim. I kn no way want anyone in RAS to take sides on who is right or wrong, but if Tom is to state that I "worked for" or was a "partner" of SearsGroup is not true. I must defend that position due to This reason: I have never signed anything, either on contract basis or partnership, with any company or persons stating that I work for or are a partner of a company or group of people, whom use a Papyrus product to earn money or has the potential to earn money. This would be a direct violation of other legalities signed with other parties. I MUST defend this arguement by Tom Pabst or be held liable with other companies. This also happens to be the basis of Pabst's law suit against me. Even his attorney agrees that if I were NOT an employee of SearsGroup, then SG would have no claim on Sears99. I called Tom's lawyer this morning. I told him I am at the point of either Pabst and the fictional SearsGroup company either sit with me to work out a solution to this problem, or bring me to court. That is it, I am done with this issue unless someone serves me with a summons. My response to Tom's posting of legal documents on this newgroup is complete outrage. The long post that Tom made yestersay will not get a reposnse from me, as I am too disgusted to even respond. Sears99 belongs to no one person and can not. The files contained within are of papyrus code and can not be "owned" by anyone other then them. Any one of two companies can kill Sears99 and those are Papyrus and Sears Point Raceway. I have not recieved a letter or phone call from either, asking to stop the distribution of Sears99. Though Steve Page of Sears Point has asked that I no longer use "copyrighted images" of SPR, in which I am complying. On Fri, 08 Sep 2000 17:19:33 GMT, "Herko ter Horst" <[email hidden]> wrote:
