Notable threadIRL forces end of John Bodin's IRL Heat mod

John Bodin announced that his IRL Heat 2000 and 2001 mods for NASCAR Heat had been terminated and removed after the Indy Racing League sent a cease-and-desist letter, citing exclusive rights granted to another developer. Posters thanked Bodin and condemned the IRL and Tony George as short-sighted. Others noted that the letter was polite and that an exclusive licence could make the mod a genuine contractual problem.

I regret to inform the sim racing community and fans of the Indy Racing League that the IRL Heat project has been terminated -- no future updates or patches will be developed in support of this effort, and the IRL Heat 2000 and IRL Heat 2001 files have been removed from all Internet sources within my control. The termination of the IRL Heat project comes at the request of the Indianapolis Motor Speedway. See the IRL Heat Web site for the full details: http://irlheat.bhmotorsports.com/ -- John Bodin Publisher, The IRL Insider Magazine http://irlinsider.adnetweb.com/
So little ol John Bodin was a threat to the spawn of Satan was he? somehow I think "request" was the wrong word to use...more like: demanded???? Hey John, even tho I'm not a fan of the league, I do appreciate the close racing they get AND ESPECIALLY your efforts. Thanks for putting that mod out there......and may 'He With NO Name' rot in hell. dave henrie "John Bodin" <[email hidden]> wrote in message news:[email hidden]...

I'll second that. Judging by the # of fans the IRL has watching any race, you'd think they'd encourage this.......but that would require rational thinking, which goes without saying doesn't exist there. -John Dave Henrie <[email hidden]> wrote in message news:WMEN7.2812$[email hidden]...

John, I really hope Audi doesn't step up next and say the AutoUnions have to go! Stephen p.s. sorry for no feedback on the SOH thing. The combination of a hellish workload and a wimpy computer made it all rather futile, but I certainly liked what I initially saw. Really liked it. Almost enough to go computer shopping. I don't think the message was that bad, actually. The first paragraph almost looks like they are sorry. They do explain that the availability of the mod means they were breaking their contract with another developer which presumably has exclusive rights. -- -asbjxrn

Blame it on the lawyers Dave, everything has to do with copyrights these days, course, the mighty dollar has something to do with it as well, but somehow I get the impression that people in the auto racing industry doesn't really care what "we" do with 3rd party stuff, *until* someone starts screaming about having paid good money for licensing rights, in which case they *have* to go out there and protect their copyrights or face a law suit for contract breach and what not Shame it hits 3rd party not for profit guys like John and his team, having talked to Jan Kohl about the Daytona project "The Pits" was doing a few years ago, I have a good feeling how frustrating is facing a lawsuit for doing something for others without even making money from it On the other side, does this mean more effort can be but into other NHeat mods such as AussieV8's ? :-) Beers and cheers (uncle) Goy "The Pits" http://www.theuspits.com/ * Spam is for losers who can't get business any other way * "Spamkiller" http://www.spamkiller.com
John -- Thanks for all the hard work you put into this effort. I have to agree with several others that the letter you got from IRL was hardly what one could term a "request", but you have put the best face on it. Also, like many others, I am disappointed in the raging egos of everyone involved in this ridiculous CART/IRL split, perhaps Tony George most of all. Be that as may, I'd be willing to bet that whatever "gaming company" IRL is working with, the product will be a stinker, as have most games been when the real-life franchise is calling the shots. A labor for profit can never have the intrinsic quality of a labor of love. BB
The "Sorry, but there's another game under development" line of bs is the first one always used in these circumstances. Believe it when you see it, as in never. -John > I don't think the message was that bad, actually. The first paragraph > almost looks like they are sorry. Sorry to see all of your hard work go to shit, John. Even though I really can't stand TG and the way he handled (caused) the split, it's a shame that the IRL'ers won't have a quality sim to call their own. Warlock! John Bodin wrote:

Sorry John, I don't buy it, First, congratulations on pissing off a big company; applause is due. Second, nothing legal takes just two weeks. And, less than $500 alone will get you an injunction from your local pissed-off attorney, if and when they think your a real threat to IMS. They're just using you for free advertising John, nothing else. Third, who says that supposed game coming out isn't for Xbox or something other than a PC, and if so who in your community would benefit from that? Perhaps there's a class action out there waiting to happen. :) Practically speaking, it most likely took 10 minutes for missy to write off an email claiming unfounded rights and I have serious doubts any attorney was consulted. She probably read the same disclaimer in the box everyone else gets to read. God help me, nothing pisses me off more than someone inflicting their ego on someone else. The very least you should do is email back, "I'll look into into it.". Then ignore them and wait for a letter from an attorney, which will never come of course. Do you have any idea how many people hoped, one day, some big infringment threat would come knocking on their little world and put their name out there? IF, and this is a big fat if, there were a legal ground for them to stand on, you'd bet your ass you'd have heard from their legal department first. Why not just hack the game in such a way as to let the user create the image(s) where IRL is used and tell them to sue that? Keep in mind that when a corporation is in a lawsuit they have to be represented by legal counsel; it's the law; You do not. If your not already rich or have your own business, and it's using the same federal tax I.D. as your project (If any), and your certainly not charging for your project anyway, there's nothing to win in a court of law. Any attorney who had to take the bar 5 times will tell them it ain't worth it. Lordy lordy I wish I were in your shoes John. :) I used to sell software and when I sold my company I had to deal with the same concerns; i.e. one prospective wanted all types of insurances that not only was I going to not support any users of my software, but I would SUPPORT their efforts to enforce any copyright infringement ! What balls huh. Everything went fine with the lawyers until measures to prevent altering the software came up. When I saw my legal bill would triple I pulled the plug and went with someone else. Someone who valued what we had done and didn't try to use me as leverage. I will always argue that if your not charging, your more than welcome to hack any game you want. For more people than we like to think that's the reason some buy the game. If it were me John, and I have some experience here, I wouldn't succumb to idle threats on something I loved until bubba shoved his burry ass through my front door and called me a bitch. Then I'd call MY ass-kicking attorney. Thoughts for You to ponder... You'd be surprised how little an attorney will charge to 'write a letter'. Quake source code is readily available on the internet and I don't see anyone shutting these guys down. What you are doing is helping the simulator racing community, not promoting your own means. Your are NOT creating an IRL game, your hacking Nascar Heat. I'd say Hasbro would have more rights than IMS here. In the legal world I know, there is what is called precedence. In order for them to have a case, they have to prove they made a valid attempt at shutting down every single occurance on the internet, or ANY other source, for ANY alterations in the game! Ignore this idle threat, I beg you, if that's your only reason for stopping your development. If your in love with what you do, scour the internet, FOR FREE, on any information helping in you your defense. Hell, I'll post all your work on my website if you want (giving mau all the credit of course <vbg>). Feel free to take this email and the one you received from IMS to a local attorney and, if he's any good, he'll ask enough questions that in 15 minutes he'll know enough to tell you exactly what to do. Jesus Christ, I only wished MS had the audacity to try to come down on me when I was selling software. I take copyright infringement very serious. Abuse of it cost me a lot of money. But so did ignorance of the law. If your not convinced your in the driver sit, look at it this way... Think of the publicity you'll get if they actually drag you into court (BTW they have to sue you in your state, not theirs, which mean they have to find a lawyer in another state who will take their case :). Threats don't mean anything to the average media until it becomes public record. For all you know, some venture capitalist will think IRL is worth something and fund You! What is worth loving is worth fighting for John That piece of work calling herself a licensing manager is probably drinking her coffee, thinking, "ya, tha took care of that". 10 bucks says Annette is the girl selling ear plugs in the stands. Several thoughts on this: 1. Thanks, Jon, for providing a decent sim-mod of a basically ignored segment of racing. I sincerely appreciate the recreational enjoyment that you have provided to me free-of-charge. 2. I wonder if you are really creating a breach of contract or if this is just some sort of power-play. I'm suspicious, since your effort is non-profit and you have not entered into any contractual agreement with IMS. 3. I have no confidence that a competent sim of Indy Racing is going to be produced. Other licensed efforts have stunk, so why should we believe that this one will be any different? The sim racing community's "need" which had been previously unaddressed gave birth to the IRL Heat projects. Now we are to believe there were plans all along to meet this need. 4. Using the logic offered, I don't see how the sim community is free to produce any cars, mods, tracks, etc. of anything. I think if you look hard enough you'll find that everything associated with motorsports is the intellectual property of somebody. Using the logic offered I find it hard to believe we're not continually breaching contracts or violating somebody's property. 5. When Ubisoft did not have a license to produce an F1 game, they produced Monaco Grand Prix Racing Simulation 2. The names were changed to disguise what sort of racing was being simulated but simmers soon provided their own seasons, etc. restoring appropriate driver names, car names, etc. I assume what Ubisoft did was legal. Likewise, I would think that you might be free to do the same if you choose. Instead of calling the mod IRL Heat 2001 you might call it LOW (Lame Open Wheel) Racing, as in "How LOW can ya get!" If as they claim, they have given a company exclusive rights to make car sims with the IRL name, another easily available sim with the same name could be a breach of contract. Someone paid a lot of money to be the only ones able to use the IRL name to sell more games. If they see that anyone can get a free IRL game off the net, they will claim that they may lose sales because of that. And that is what it all boils down to, the almighty dollar. > 3. We're not free to do so, and we're continually violating somebody's property. They either don't know about it or they don't mind. Why should they? It may even build a fanbase so the license is more worth the day a developer approches and wand to make a game. But if that developer is paying another million to be the ONLY sim of that type, they're going to send letter to Bodin.

Again-where are all the golf course owners that (should, according to the above precedent) complain when their courses are designed via Jack Nicklaus Golf or LINKS and posted on the net? Either they, unlike racetrack owners, don't care (and see it as free publicity), or there is some fundamental legalistic difference between racetrack ownership and golf course ownership. Perhaps that's it: golf courses can be played by most anyone (public courses like Pebble Beach being completely accessible if you have the $$$), but you can't exactly drive up to Daytona, pay a fee to some guy in a toll booth, and drive onto the track. Publicity in the former, via simmed courses, would then be seen as favorable (more greens fees), but in the latter you can't drive it unless you are a certified professional. >shrug< At any rate I guess we shouldn't hold our collective breath waiting for a track design utility in any upcoming sim... :-p John DiFool

This is not a cool thing. The IRL has had few friends, and to pull this kind of legal BS to one of the staunchest supporters of the IRL is just wrong. All this will do is further anger people who are just looking for an axe to grind with the IRL. It is very short sighted in my opinion. -- btgoss btgoss(my_shorts)@yahoo.com Remove my shorts to reply "Larry" <[email hidden]> wrote in message news:JWkO7.125971$[email hidden]... > Creativity, squashed once again :( > > > "John Bodin" <[email hidden]> wrote in message > news:[email hidden]... > > I regret to inform the sim racing community and fans of the Indy > > Racing League that the IRL Heat project has been terminated -- no > > future updates or patches will be developed in support of this effort, > > and the IRL Heat 2000 and IRL Heat 2001 files have been removed from > > all Internet sources within my control.
